Each Creator is solely responsible for the Content on their own profile and broadcasts. Rappio.TV does not guarantee the accuracy, quality, or legality of User Content, and we are not liable for any Content posted by any User, whether or not Rappio.TV has reviewed such Content. By using the Service, you understand that you may encounter Content that you find objectionable or inappropriate, and you access the Service at your own risk. Rappio.TV provides the technological platform and tools to facilitate streaming, interaction, and Content sharing. We do not have editorial control over the Content that Creators choose to stream or share, aside from enforcement of these Terms and our policies. Rappio.TV is not a publisher of Users’ posts or streams; we function as an intermediary service provider. Nothing in these Terms shall be construed as creating any partnership, joint venture, or employment relationship between Rappio.TV and any User – Users act independently and are not agents of Rappio.TV. 4. Eligibility (Age and Legal Capacity) Minimum Age Requirement (18+). The Service is intended ONLY for adults. You must be at least eighteen (18) years of age (or the age of majority in your jurisdiction, if higher than 18) to create an account or use the Service. By accessing or using Rappio.TV, you represent and warrant that you are 18 or older and fully competent to enter into and comply with these Terms. We do not knowingly allow any individuals under 18 to use the Service. If you are under 18, you are strictly prohibited from accessing or using Rappio.TV in any manner. Higher Local Age Requirements. In addition, certain content available on Rappio.TV may be subject to higher age restrictions under your local laws. It is your responsibility to comply with any higher minimum age requirement that is applicable in your jurisdiction for viewing or participating in particular types of content. For example, if your local law deems certain content (such as sexually explicit adult content or gambling-related promotions) as restricted to those 21 years or older, or any age above 18, you must only use the Service if you meet that higher age requirement. The default minimum age to use Rappio.TV remains 18, but where applicable law requires a higher age for specific content, you must abide by that law. You are solely responsible for knowing and obeying the age restrictions in your location. Personal Eligibility. By using the Service, you further represent that: (a) you are not currently suspended or banned from using the Service; (b) you have not previously had an account terminated by Rappio.TV for violation of these Terms or law; and (c) you are not a person barred from using the Service under the laws of any applicable jurisdiction (for example, you are not on any trade sanctions list or legally prohibited from using internet services). 5. Legal Use of the Service and User Responsibility for Compliance User’s Responsibility for Legality. Rappio.TV operates as an international service, and we do not monitor or control which jurisdictions our Users access the Service from. We do not utilize geoblocking or active measures to prevent access based on location, and we do not verify whether your use of the Service is lawful in your specific country or region. It is entirely your own responsibility to determine whether your access to or use of Rappio.TV is legal in your jurisdiction. By using the Service, you affirm that you have verified that nothing in your local laws or regulations prohibits or restricts your use of the Service or any Content available on it. If any such restrictions apply, you must refrain from using Rappio.TV. No Use Without Verification of Legality. You are explicitly prohibited from using the Service if you have not confirmed that doing so is lawful in your jurisdiction. If you are unsure or have any doubt about whether the Service (or certain content on it) is legal for you to use or view in your location, you must not proceed to use the Service until you obtain clarity from a competent local authority. We strongly advise you to consult your local laws or regulatory authorities if you are uncertain of the legal status of online streaming content (including adult-oriented or other regulated content) in your region. By accepting these Terms, you affirm that you have taken all necessary steps to ensure your use of Rappio.TV is in compliance with all laws applicable to you. If at any time you discover that using the Service is not permitted in your location, you agree to cease using the Service immediately and, if you have an account, to delete or deactivate it. No Age/Identity Verification by Rappio.TV. Rappio.TV itself does not perform age or identity verification on users at the point of account registration or login. We rely on the representations and warranties you make under these Terms regarding your eligibility. Any age or identity verification measures that may be required for accessing certain content or features will be carried out by trusted Third-Party Providers, not by Rappio.TV directly (see Section 6 below). Rappio.TV does not collect or store personal data for age or ID verification purposes; thus, the onus is on you to ensure you meet the eligibility criteria. 6. User Accounts and Security Account Creation. To access certain features of the Service (for example, to stream content or interact with streams), you may need to create a user account. When creating an account, you agree to provide truthful, accurate, current, and complete information about yourself as prompted by the registration process. You further agree to keep your account information updated so that it remains accurate and current at all times. You must not impersonate any other person or use any personal details or payment information that you are not authorized to use. Account Credentials. You are responsible for maintaining the confidentiality and security of your account login credentials (such as username and password). Do not share your password or allow any other person to access the Service through your account. You agree to notify us immediately at hop@rappio.tv if you suspect or become aware of any unauthorized use of your account or any other breach of security. Rappio.TV will not be liable for any loss or damage arising from your failure to safeguard your account credentials. Account Use and Liability. You are fully responsible for all activities that occur under your account (whether or not authorized by you), and for any consequences of unauthorized access. Rappio.TV may assume that any communications or actions taken through your account were made by you. We encourage you to use a strong password and enable any available security features to protect your account. One Account Per User. Unless expressly permitted by Rappio.TV, you agree not to maintain more than one active account on the Service. Creating multiple accounts to circumvent restrictions, bans, or limitations is prohibited and may result in termination of all associated accounts. 7. Age and Identity Verification (Third-Party Services) Third-Party Verification Process. Certain content on Rappio.TV—such as adult-oriented streams or other sensitive or regulated content—may require verification of your age or identity before you can access or participate in it. Rappio.TV does not conduct such verification itself. Instead, we utilize independent, vetted Third-Party Providers to handle all age and identity verification processes. These third-party verification services are industry-recognized providers that employ secure methods to confirm a user’s age or identity. For example, we may direct you to a third-party service where you will be asked to provide proof of age (such as an ID document or biometric check) solely for the purpose of verification. No Personal Data Collected or Stored by Rappio.TV. Rappio.TV does not collect, receive, or store the personal data or documentation that you submit to Third-Party Providers for verification. All sensitive information you provide in the verification process (e.g., government ID details, facial images, date of birth, etc.) is transmitted directly to the external provider over secure channels. The third-party will verify your eligibility (for example, confirm that you are 18+ or of required age) and will simply send Rappio.TV a yes/no confirmation or a token indicating whether you have passed the verification. Rappio.TV’s servers do not retain your personal verification data. Because we delegate this function, we have no access to, and no control over, the personal data you submit for verification beyond receiving the result. We value your privacy and choose to outsource age/ID checks specifically to avoid holding sensitive personal data on our platform. Third-Party Provider Terms. When you engage in an age or identity verification through a Third-Party Provider, you may be required to agree to that provider’s own terms of service and/or privacy policy. Any personal data you provide to the verification provider is subject to their privacy practices, not Rappio.TV’s. While we carefully vet our verification partners for security and compliance, Rappio.TV disclaims any liability for the acts or omissions of these third parties, including their handling of your data. We encourage you to read and understand the third-party’s terms and policies before proceeding with a verification process. If you do not wish to undergo third-party verification when prompted, you will not be able to access the age-restricted or otherwise controlled content or feature. User Cooperation. You agree to cooperate fully with any reasonable requests by a verification provider or by Rappio.TV (through the provider) to provide accurate information and documentation for purposes of age or identity verification. If you fail or refuse to complete a required verification, Rappio.TV may suspend or restrict your access to certain features or content until verification is successfully completed. Any attempt to circumvent the verification process, provide fraudulent information, or otherwise misrepresent your age or identity is a serious violation of these Terms and may result in immediate termination of your account. 8. Third-Party Services and Links Integration of Third-Party Services. In addition to age/ID verification providers, Rappio.TV may integrate, utilize, or provide links to various Third-Party Services as part of offering the Service. Examples may include payment processors for handling transactions, content delivery networks, analytics providers, advertising partners, social media integrations, or links to third-party websites or content (such as a Creator’s personal site or sponsor). These services are provided to enhance the functionality and user experience on Rappio.TV but are not under our control. No Endorsement or Control. Any third-party websites, content, or services that can be accessed via links from Rappio.TV or that are used in conjunction with the Service are not endorsed by us and are not governed by these Terms. Rappio.TV does not control and is not responsible for the content, offerings, availability, accuracy, or practices of any third-party websites or services. If you access a third-party website or service from the Rappio.TV platform (for example, by clicking an external link or interacting with a third-party widget), you do so at your own risk, and you understand that these Terms and Rappio.TV’s policies do not apply to those third-party sites or services. Third-Party Terms and Policies. Your use of any third-party service or feature will be subject to that provider’s terms of service and privacy policy (not Rappio.TV’s). It is your responsibility to review the applicable third-party terms before using their service. Rappio.TV assumes no responsibility or liability for any data collection, privacy practices, content, advertising, products, services, or other materials on or available from such third parties. If you have any concerns or disputes arising from a third-party service, you should address them with the third party directly. Interactions with Third Parties. Any interactions, transactions, or agreements between you and any third party (including other Users, advertisers, or service providers) are solely between you and that third party. Rappio.TV will not be responsible for any loss or damage incurred as a result of such dealings. If a third-party integration on Rappio.TV is not functioning properly or is causing issues, please notify us, and we may attempt to resolve or liaise with the provider, but we do not guarantee resolution. 9. Acceptable Use Policy (User Obligations and Prohibited Conduct) By accessing or using the Service, you agree to abide by the following Acceptable Use Policy. You are solely responsible for your conduct on Rappio.TV and for any Content that you upload, stream, or share. You agree not to engage in any of the following prohibited activities: Illegal or Unauthorized Content/Activities: Do not upload, transmit, stream, or otherwise make available any Content that is illegal, unauthorized, or otherwise violates any Applicable Law. This includes, but is not limited to, content that is unlawful, obscene, defamatory, libelous, harassing, threatening, hateful, racially or ethnically offensive, or that encourages conduct that would be considered a criminal offense or give rise to civil liability. You also agree not to use the Service for any unauthorized purpose, such as conducting fraudulent activities, money laundering, gambling (unless explicitly permitted and properly regulated), or terrorist activities. You must obey all Applicable Laws while using Rappio.TV, and you are responsible for ensuring that your content and activities are lawful in your jurisdiction as well as in any jurisdiction where your content may be viewed. Child Exploitation and CSAM (Zero Tolerance): You must not post, transmit, or solicit any content that involves or depicts minors (anyone under 18) in any sexual, suggestive, or exploitative manner. Rappio.TV maintains a zero-tolerance policy toward Child Sexual Abuse Material (“CSAM”) or any content that sexually exploits or endangers children. Any attempt to upload, share, or facilitate the distribution of CSAM is strictly forbidden and will result in immediate account termination and removal of content. We will report any suspected CSAM, child exploitation, or grooming behavior to the appropriate law enforcement authorities without delay. Users engaging in such behavior will be permanently banned without prior notice. and Rappio.TV will cooperate with law enforcement by providing any necessary information about the offending users. Pornography and Sexual Content: If you are a Creator streaming adult-oriented or pornographic content permitted on Rappio.TV, you must ensure all participants are adults over the age of 18 (or higher if required by local law) and that such content is legal in all jurisdictions where it could be viewed. Any revenge porn, non-consensual sexual content, bestiality, or incest content is strictly prohibited. Explicit sexual content must be properly categorized or age-gated as required by Rappio.TV’s platform rules. For Viewers, you agree not to access any adult-themed streams unless you are of legal age and it is lawful for you to view such material. Violent or Graphic Content: You must not post excessively violent or graphic content that is likely to be deemed disturbing, except in a context that is clearly documentary, educational, or newsworthy (and in compliance with platform guidelines). Content that glorifies or incites violence, terrorism, or physical harm against any person or group is prohibited. Harassment and Hate Speech: Do not harass, bully, or threaten other users. You agree not to incite hatred or violence or discriminate against others based on factors such as race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or any other characteristic protected by law. Hate speech and any Content encouraging harm or prejudice towards any group is forbidden. Personal attacks, stalking, or doxxing (publishing others’ private information) is also prohibited. Impersonation and Fraud: You must not impersonate any person or entity, or falsely claim an affiliation with any person or entity. Do not fraudulently misrepresent yourself, your identity, or your qualifications while using the Service. You also agree not to engage in phishing, scam attempts, or any deceptive practices to trick other users out of personal information, login credentials, money, or property. Intellectual Property Infringement: Do not upload or share content that infringes the copyrights, trademarks, trade secrets, or other intellectual property or proprietary rights of any person or entity. This means you should only share content that you have created, that is in the public domain, or that you have permission or a legal right to use. Unauthorized streaming or rebroadcasting of copyrighted content (such as TV shows, movies, music, sports events, etc.) without permission is a violation of these Terms. If you use any third-party content in your stream (e.g., background music, clips), ensure you have the appropriate licenses. Rappio.TV respects intellectual property rights and will respond to clear notices of alleged infringement (see Section 10 below for content removal and IP complaints). Malicious Software and Network Abuse: You agree not to upload or transmit any software viruses, worms, Trojan horses, logic bombs, or any other malicious code or material that is intended or likely to disrupt, damage, or interfere with the proper function of the Service or others’ computers (or to surreptitiously intercept data or personal information). Additionally, do not engage in any activities that interfere with or disrupt the servers, systems, or networks connected to the Service (for example, no denial-of-service attacks, no spamming the platform with repetitive content, no using automated means like bots/scrapers to mass-download or mass-post content). You must not try to bypass any security or access restrictions of the Service, and you must not attempt to probe or test the vulnerability of our systems without authorization. Circumvention of Restrictions: You must not attempt to circumvent any content filtering techniques, age-gates, or digital rights management measures that we have put in place. For example, do not attempt to use VPNs, proxies, or false information to evade geographic or age-based access restrictions if such are implemented for certain content. If you have been suspended or banned, you must not create a new account to circumvent that action without our permission. Unauthorized Data Collection: You are prohibited from collecting or harvesting any personal data from the Service about other users (such as names or account information) without their consent. Automated data scraping, crawling, or any use of spiders or bots to gather information from Rappio.TV is forbidden, except as may be allowed by a robots.txt file or with our prior written consent for legitimate purposes (e.g., search engine indexing). Commercial Activities and Advertising: Unless expressly permitted by Rappio.TV, you must not use the Service for the primary purpose of conducting commercial activities or advertisements. For instance, you should not spam users with promotional content, run contests or lotteries that violate law, or solicit others for business transactions unrelated to the streaming content without appropriate authorization. Creators may promote their own content or merchandise in compliance with our guidelines, but overt third-party advertising and sponsorships must comply with Rappio.TV’s rules and any Applicable Law (such as clearly disclosing sponsored content where required). This list of prohibited conduct is not exhaustive. Rappio.TV reserves the right, at its sole discretion, to determine whether any User conduct or Content is objectionable or violates these Terms or the law. Violation of this Acceptable Use Policy may result in enforcement action as described in Section 15 (Termination and Enforcement), including removal of content, suspension or termination of accounts, and involvement of law enforcement authorities where appropriate. 10. User-Generated Content and Licensing Your Content, Your Responsibility. Rappio.TV may allow you to create, upload, stream, or post Content (your “User Content”). You retain any ownership rights you have in the User Content that you create. Rappio.TV does not claim ownership of your User Content. However, by making your Content available on the Service, you assume full responsibility and liability for that Content. You represent and warrant that you either own or have all necessary rights and permissions to upload/share the Content and to grant the license below, and that your Content (and Rappio.TV’s use of it in accordance with these Terms) does not and will not infringe or violate the rights of any third party, including intellectual property rights, privacy, publicity, or any other legal rights. License Grant to Rappio.TV. By uploading, streaming, or submitting any User Content on or through Rappio.TV, you hereby grant Rappio.TV a worldwide, non-exclusive, royalty-free, fully-paid, sublicensable, and transferable license to host, store, use, reproduce, modify (for technical purposes, e.g. to fit various devices or formats), create derivative works of (e.g. excerpts or previews), distribute, transmit, stream, publicly display, and publicly perform your User Content solely for the purpose of operating, improving, promoting, and providing the Service. This license allows us, for example, to display your streams to other users, to transcode your videos for playback, to show thumbnails or clips of your content, and to distribute your content across our networks and partner distribution channels as needed to deliver the Service. Rappio.TV does not obtain any ownership in your Content under this agreement; the rights you grant us are for the limited purpose described and for the duration that your Content is available on the Service. You can generally remove your Content from the Service at any time (subject to any account termination or content removal rules), and upon removal, this license will terminate after the time reasonably necessary for full deletion from our systems. However, you understand that even after removal, we may retain server or backup copies for a limited period (not visible to others) and that Rappio.TV is not responsible for Content that has been shared or captured by other users through the Service (for example, if a viewer recorded your live stream). In such cases, the license granted by you will continue to apply to that other user’s copy of your Content until they delete it. License Grants to Other Users. By using the Service and posting Content publicly, you also grant each User of Rappio.TV a non-exclusive license to access and view your Content through the Service (e.g., viewers have the right to watch your streams) and to use that Content as permitted through the functionality of the Service and under these Terms. For instance, viewers may, subject to your settings and our features, create clips of your streams or share your content within the platform. You can control some of these aspects through your Creator settings if available. If you choose to make certain Content available only to specific users (e.g., subscribers or private streams), you grant those users the license to access and view that Content under the same principles. No Compensation. You agree that the license grants above are made to Rappio.TV and other users without any right to payment to you. You will not be entitled to any compensation from Rappio.TV for the use of your Content as authorized in these Terms, except to the extent (if any) provided for under a separate Creator monetization program explicitly offered by Rappio.TV (and subject to additional terms). Content Guidelines and Moderation. While Rappio.TV is not responsible for User Content, we reserve the right (but do not assume the obligation) to monitor, screen, edit, remove, or disable any User Content at our discretion at any time and for any reason, especially if we determine that the Content violates these Terms (including the Acceptable Use Policy above) or may harm our users, our platform, or third parties. We also reserve the right to block access to any Content, or to refuse to post any Content, that we believe is objectionable or excessive in volume, or that for any other reason is causing operational or security issues. However, Rappio.TV does not pre-approve Content and cannot guarantee prompt removal of violating content. You acknowledge that Rappio.TV is a platform and some Content may be in violation of our Terms without our knowledge. Users are encouraged to report any content they believe violates our Terms or policies (see “Reporting Violations” below). User Feedback and Reporting Violations. If you discover any Content on the Service that you believe violates these Terms or is otherwise illegal or inappropriate, you are encouraged to report it to us. You may use any in-platform reporting tools or contact us directly at hop@rappio.tv to report violations, including suspected child exploitation, harassment, or intellectual property infringement. Rappio.TV will review reports promptly and take appropriate action, which may include removing content, suspending or terminating accounts, and/or alerting law enforcement as required by law or in our discretion for serious matters. Knowingly submitting false or malicious reports is a violation of these Terms. DMCA and Intellectual Property Complaints. Rappio.TV respects the intellectual property rights of others and expects Users to do the same. If you believe that any Content on the Service infringes your copyright or other intellectual property rights, you (or your agent) may send us a written notice providing the details of the alleged infringement. Such notice should include sufficient information for us to identify the Content and verify your ownership (or authorized agency) of the intellectual property. Please send IP complaints to hop@rappio.tv with the subject “IP Infringement Notice.” Upon receiving a compliant notice, Rappio.TV will expeditiously investigate and, if appropriate, remove or disable access to the allegedly infringing Content and notify the affected user so they have an opportunity to respond (in accordance with applicable law, such as the U.S. Digital Millennium Copyright Act (DMCA) procedures, if applicable). Repeat infringers will have their accounts terminated. (Note: For more details on our copyright policy or designated DMCA agent (if applicable), please refer to any separate Copyright/DMCA policy we maintain.) No Storage Obligation. Rappio.TV is not a backup service. We do not guarantee that your Content will be stored or retrievable on the Service. We encourage you to keep copies of any Content you consider valuable. Rappio.TV is not liable to you for the loss or deletion of any of your Content. 11. Rappio.TV’s Intellectual Property and License to You Our Intellectual Property. Apart from User Content, all content and materials on the Service, and all software, technology, designs, components, and intellectual property that make up the Service (“Rappio.TV Materials”) are owned by or licensed to Rappio.TV and are protected by applicable copyright, trademark, patent, trade secret, and other intellectual property laws. This includes (but is not limited to) the Rappio.TV name, logo, and all related branding, the user interface, design elements, look and feel, the compilations of Content, the underlying software code and databases, and any content provided by Rappio.TV itself (such as text, graphics, or promotional materials that we create). All Rappio.TV trademarks, logos, service marks, and trade names are the property of Rappio.TV or its licensors. You do not acquire any ownership interest in any Rappio.TV Materials by using the Service or by virtue of the licenses granted to you below. Your License to Use the Service. Subject to your compliance with these Terms, Rappio.TV grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service and any Rappio.TV Materials solely for your personal, non-commercial use (or for your legitimate business use as a Creator on the platform), and solely as intended through the normal functionality of the Service. This license is provided for the sole purpose of enabling you to use and enjoy the benefit of the Service as provided by Rappio.TV, in the manner permitted by these Terms. Any unauthorized use of the Service or Rappio.TV Materials is strictly prohibited and will result in termination of the license. You may not copy, modify, distribute, perform, display, or create derivative works from our Service or Materials (except for your own User Content, as allowed) unless expressly authorized by Rappio.TV. You must not reverse engineer, decompile, or attempt to extract the source code of any software or portion of the Service, unless allowed by Applicable Law (in which case you must first notify us). Use of Rappio.TV Marks. You are not permitted to use Rappio.TV’s trade name, trademarks, logos, domain names, or any other brand features (“Marks”) without our prior written consent, except as necessary to identify the Service (such as in a truthful review or commentary in accordance with nominative use principles). Any permitted use of Rappio.TV’s Marks must be in compliance with any guidelines that we provide. All goodwill arising from the use of Rappio.TV’s Marks inures to our benefit. Third-Party Content. The Service may contain content or components provided by third parties (e.g., libraries, APIs, or licensed media). Use of such third-party content may be subject to additional terms of the third party. Where those third-party terms apply, we will make efforts to notify you (for example, via an open source attribution notice within our app or site). You agree to comply with all applicable third-party terms when using the Service. We are not responsible for third-party content or terms. Feedback. If you send or provide any suggestions, feedback, improvements, or requests for features to us (“Feedback”), you acknowledge that such Feedback is provided on a non-confidential basis, and you hereby grant Rappio.TV an unrestricted, perpetual, irrevocable, royalty-free license to use, implement, and otherwise exploit that Feedback for any purpose, without any obligation to compensate you. We appreciate Feedback, but please know that we may have already conceived of or developed something similar to your Feedback, and this clause ensures no disputes arise from our use of general ideas. 12. Privacy and Data Protection No Personal Data Collection (Platform Practices). Rappio.TV is committed to user privacy. Uniquely, Rappio.TV does not itself collect or store personal data from users beyond what is minimally necessary to operate the Service (for example, a username, password, and contact email). We do not require you to submit personally identifying information to browse the platform, and we do not perform any personal data processing for age/identity verification (as noted in Section 7). All sensitive personal information for verification or payments is handled by Third-Party Providers, and Rappio.TV’s systems are designed to avoid ingesting that data. Because we deliberately limit the personal data we collect, we have no data to sell or share for marketing purposes, and we avoid retaining personal information on our servers whenever possible. Delegation to Third Parties. As described earlier, tasks involving personal data (such as confirming age or identity, or processing payment information) are outsourced to trusted third parties. These third parties are contractually obligated to handle your data securely and in compliance with Applicable Law. However, any data you provide to them is governed by their privacy policies, not ours. Rappio.TV does not receive your sensitive data from these providers—only the results (e.g., a verification pass/fail, or a payment confirmation token). We assume no responsibility for how third-party providers collect, use, or store your personal data, but we choose reputable providers and require them to meet high data protection standards. User Privacy Choices. Because we collect virtually no personal data, issues of consent and data access are minimized. We may use cookies or local storage for preferences or session management, but these do not collect personal details. If you choose to provide us information (for example, contacting support via email), we will use that information only to assist you and will not keep it longer than necessary. By using the Service, you consent to Rappio.TV’s limited collection and use of information as described here and (if applicable) in our separate Privacy Policy. If you have any privacy-related questions or requests (such as data access or deletion requests), you may contact us at hop@rappio.tv. Compliance with Laws. Rappio.TV is designed to comply with international data protection principles by minimizing data collection. We aim to comply with privacy laws such as the EU’s GDPR, California’s CCPA/CPRA, and similar frameworks, to the extent they apply, principally by being data-sparing. Since we generally do not collect personal data (especially not of minors), we do not anticipate holding data subject to special protections (like children’s data under COPPA or sensitive personal data). If any Applicable Law imposes requirements on us regarding personal information, we will comply and update our practices or Privacy Policy accordingly. Users are expected to comply with their local privacy laws when using the Service (for instance, as a Creator, if you collect personal info from viewers in any way, you must do so lawfully). Data Security. We implement reasonable and appropriate security measures to protect any data we do hold (such as your account email and password) from unauthorized access, alteration, or destruction. However, no online service is 100% secure. You are responsible for keeping your account credentials secure, as noted in Section 6. Please notify us immediately of any unauthorized access or suspected breach related to the Service. We make no promises or guarantees that the Service will meet your requirements or expectations, that it will be uninterrupted, timely, secure, or error-free, or that any content (including User Content) will be accurate, reliable, complete, or safe. No Guarantee of Content or Features. Rappio.TV does not warrant that any particular Content will be available on the Service or that certain features or functionalities will continue to be provided. All content, information, and services provided on or through Rappio.TV are provided for entertainment or general informational purposes only. We do not endorse any opinions expressed by Users on the platform. Rappio.TV is not responsible for any errors or omissions in any Content, nor for any damages or losses you might incur in connection with viewing or relying on Content posted on the Service. You understand that streams may be live and unmoderated, and viewer discretion is advised. Service Operation and Security. We do not warrant that the Service will be secure or free of viruses, malware, or other harmful components. While we strive to maintain a safe and secure environment, we cannot guarantee the absolute security of the Service or that unauthorized third parties will never be able to defeat our security measures. You are responsible for using up-to-date antivirus software on your device. Any material downloaded or otherwise obtained through the use of the Service is done at your own discretion and risk. Third-Party Services and Content. Rappio.TV makes no warranties or representations regarding any Third-Party Services, websites, or content linked or integrated into the Service. We have no liability for third-party conduct or content. If you encounter any third-party materials through Rappio.TV, those are provided “as is” without any warranty from us. Jurisdictional Differences. Some jurisdictions do not allow the exclusion of certain warranties. Nothing in these Terms will exclude or limit any warranty or right that cannot be excluded or limited under Applicable Law. If you are a consumer, you may have legal rights in your jurisdiction that prevent the disclaimer of certain warranties; in such case, any disclaimers in these Terms shall apply to the fullest extent permitted by law. 14. Limitation of Liability Exclusion of Certain Damages. To the fullest extent permitted by Applicable Law, Rappio.TV and its parent company, affiliates, subsidiaries, officers, directors, managers, employees, agents, partners, and licensors (collectively, the “Rappio.TV Parties”) shall not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages whatsoever, or for any loss of profits, revenues, business, goodwill, data, or other intangible losses, arising out of or in connection with: (a) your access to or use of (or inability to access or use) the Service; (b) the conduct or content of other Users or third parties on, through, or following use of the Service (including defamatory, offensive, or illegal conduct of third parties); (c) any Content obtained from the Service; or (d) unauthorized access, use, or alteration of your transmissions or Content. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if Rappio.TV has been advised of the possibility of such damage. You acknowledge and agree that Rappio.TV is a platform and you alone are responsible for your interactions and transactions on the Service. Cap on Liability. In no event shall the total liability of the Rappio.TV Parties for all claims arising out of or relating to these Terms or your use of the Service exceed the greater of: (i) the total amount (if any) you have paid to Rappio.TV for use of the Service in the twelve (12) months immediately preceding the event giving rise to the liability; or (ii) US $100.00. If applicable law does not allow the limitation of liability for certain damages (such as in cases of willful misconduct or gross negligence), the above limitations may not apply to you. However, in all cases, Rappio.TV’s liability will be limited to the fullest extent permitted by law. User Acknowledgement. You acknowledge and agree that Rappio.TV has offered the Service and entered into these Terms in reliance upon the disclaimers and limitations of liability set forth herein, which reflect a reasonable and fair allocation of risk between you and us, and are an essential basis of the bargain between us. You agree that the limitations of liability and disclaimers in these Terms will survive and apply even if any limited remedy is found to have failed of its essential purpose. Consumer Protection Notice. If you are using the Service as a consumer, some of the exclusions or limitations in this Section may not apply to you, as certain jurisdictions (including some countries in the European Union) may not allow the exclusion of certain warranties or the limitation of liability for certain types of harm. In such cases, Rappio.TV’s liability will be limited to the maximum extent permitted by Applicable Law. 15. Indemnification You agree to indemnify, defend, and hold harmless Rappio.TV and its affiliates, subsidiaries, officers, directors, employees, agents, partners, and licensors from and against any and all claims, demands, complaints, causes of action, losses, damages, liabilities, judgments, or expenses (including attorneys’ fees and costs) arising out of or related to: (a) your use or misuse of the Service; (b) your User Content (including any allegations that your Content infringes or misappropriates the intellectual property or other rights of any third party, or that it violates any law or these Terms); (c) your violation of these Terms or of any law or regulation; or (d) your interaction with any other User or third party, including any transaction or dispute between you and a Creator or you and a Viewer or any third-party service. Rappio.TV reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (without limiting your indemnification obligations with respect to that matter), in which event you agree to cooperate with Rappio.TV in asserting any available defenses. You agree not to settle any such matter without the prior written consent of Rappio.TV. This indemnification provision will survive any termination of your account or the Service. It is intended to allocate responsibility between the parties, and you acknowledge that you are responsible for your actions on the platform and the consequences thereof, and that Rappio.TV has limited control over, and will not be responsible for, your choices or conduct. 16. Suspension and Termination of Accounts By Rappio.TV (For Violation). Rappio.TV may, at any time and without prior notice, suspend, disable, or terminate your account or access to any part or all of the Service if, in our sole discretion, we determine or suspect that: (a) you have violated these Terms (or any incorporated policies or guidelines) or violated any Applicable Law; (b) you have engaged in conduct that we consider inappropriate, unsafe, or in violation of the spirit of the platform (even if not specifically mentioned in these Terms); or (c) your use of the Service could cause risk or legal exposure to Rappio.TV or any other Users. We may also remove or disable any or all Content or material that you have posted if we believe it violates these Terms or law, or for any other reasonable reason. In cases of serious violations, such as those involving child exploitation (CSAM) or other egregious abuse, termination will be effective immediately and without warning, and we will take additional steps as necessary (including preserving evidence and contacting law enforcement) For less severe issues, we may elect to provide you a warning or time to cure the violation, but we are not obligated to do so. Immediate Termination for Certain Violations. Any attempt to upload or distribute CSAM or engage in child exploitation using the Service will result in immediate termination of your account and possibly the notification of appropriate authorities. Likewise, egregious violations such as promoting terrorism, committing fraud against Rappio.TV or other users, or technical attacks on the platform will result in swift termination. Rappio.TV’s decision on these matters is final. By Rappio.TV (No Violation). Rappio.TV reserves the right to terminate the Service or your account, or to restrict or disable your access to the Service (or to certain features), for any or no reason, even if you have not violated any express term of this agreement. Although we endeavor to only use this right in reasonable circumstances (for instance, if we decide to discontinue a feature or if an account has been long inactive), you acknowledge that your account and the Service itself are provided at Rappio.TV’s discretion. We will not be liable to you for any termination or suspension of your access to the Service, or for the deletion of your Content, except to the extent that Applicable Law requires. By You. You may terminate your use of the Service at any time by deleting your account (if such functionality is provided) or by contacting us at hop@rappio.tv with a request to delete your account. You may simply stop using the Service, but if you want us to remove your personal information (if any) and account data (to the extent we have any stored), the best course is to explicitly delete your account or send us a deletion request. Please refer to our Privacy Policy for information on how we handle account deletion. Upon termination by you, you must cease all use of the Service. Effect of Termination. Upon any termination of your account or access to the Service: (a) the rights and licenses granted to you under these Terms will immediately cease (you no longer have the right to use our software, Services, etc.); (b) you will promptly destroy any copies of Rappio.TV Materials in your possession or control; and (c) any User Content you have on the Service may be (but is not required to be) deleted or unpublished by us (we are not liable for loss of your Content due to termination). However, we reserve the right to retain certain information or Content for a reasonable period of time for backup, archival, or audit purposes, and as needed to comply with legal obligations (for example, we may retain logs of activity or copies of content involved in investigations). Even after termination, any provisions of these Terms which by their nature should survive, will survive, including but not limited to ownership provisions, warranty disclaimers, indemnities, limitations of liability, and dispute resolution provisions. No Account Restoration. If your account has been terminated by Rappio.TV due to a violation of these Terms or law, you are not eligible to re-register for the Service without our express permission. Rappio.TV may block your email address, IP address, or other identifier to prevent re-registration. 17. Governing Law and Dispute Resolution Applicable Law. These Terms and your use of the Service are governed by and shall be construed in accordance with the applicable laws under which Rappio.TV operates, without regard to its conflict of law principles, except where overridden by any mandatory laws that apply to you as a consumer in your jurisdiction. We do not herein specify a particular governing jurisdiction so as to remain flexible and account for the international nature of our Service. However, we note that you are responsible for compliance with all local laws if and to the extent they apply (as described in Section 5). The choice of governing law in this agreement will not limit any consumer protection rights that you may be entitled to under the mandatory laws of your country of residence. Jurisdiction and Venue. You and Rappio.TV agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service (each a “Dispute”) shall be resolved in a forum of competent jurisdiction. In the event that the parties do not settle the Dispute through informal negotiations within a reasonable time, the Dispute shall be subject to resolution before the courts of a neutral location as determined by Rappio.TV’s then-current headquarters or principal place of business, unless otherwise required by Applicable Law. Both you and Rappio.TV consent to the personal jurisdiction of such courts and waive any objections on the ground of venue or forum non conveniens, provided that this clause shall not override any rights you have under mandatory local law to bring actions in the courts of your home country or to other protections granted to you by consumer law. Nothing in this Section shall prevent either you or Rappio.TV from seeking injunctive relief or other urgent legal remedy in any appropriate jurisdiction in cases of actual or threatened infringement, misappropriation or violation of intellectual property rights, or other instances where such immediate relief is appropriate. Alternative Dispute Resolution (Optional). At Rappio.TV’s discretion, we may elect to resolve certain Disputes through alternative dispute resolution (“ADR”) mechanisms such as binding arbitration or mediation, especially for Users located in certain jurisdictions. If we choose to offer arbitration for a Dispute, we will provide you with a notice of the arbitration procedure and rules (for example, we may utilize a well-recognized arbitration institution). You will have the right to opt out of arbitration if required by Applicable Law. Unless otherwise agreed, each party will bear its own costs in any ADR proceeding, and any arbitration will occur on an individual basis (no class arbitrations). By agreeing to these Terms, you understand that you are waiving certain rights to litigate in court (if an arbitration agreement is separately provided and you do not opt out), although at this time no mandatory arbitration is imposed by these Terms without further notice. Time Limit to Bring Claims. To the extent permitted by law, any cause of action or claim you may have arising out of or relating to these Terms or the Service must be commenced within one (1) year after the cause of action accrues, otherwise such cause of action or claim is permanently barred. (This does not apply to claims by consumers in jurisdictions where such time limit provisions are prohibited.) Users in the EU/EEA or Other Jurisdictions. If you are a consumer in the European Union, European Economic Area, United Kingdom, or other jurisdiction that provides for certain dispute resolution rights or platform for online dispute resolution: We are required to inform you that the European Commission provides an online dispute resolution platform, which you can access here: https://ec.europa.eu/consumers/odr. However, Rappio.TV is not obliged to and does not currently participate in formal alternative dispute resolution proceedings before a consumer arbitration body. 18. Modifications to the Terms or Service Changes to These Terms. Rappio.TV may revise or update these Terms from time to time in its sole discretion. If we make material changes, we will endeavor to provide advance notice to you, such as by posting a notice on our website or sending an email to the address associated with your account. Any changes will be effective on the date stated in the notice or the updated Terms. By continuing to access or use the Service after any revisions become effective, you agree to be bound by the updated Terms. If you do not agree to the new terms, you must stop using the Service and, if applicable, delete your account. We encourage you to review these Terms periodically to ensure you understand the terms and conditions that apply to your use of the Service. The “Last Updated” date at the beginning of these Terms will indicate when the latest modifications were made. Changes to the Service. Rappio.TV reserves the right to change, modify, suspend, or discontinue any aspect of the Service at any time, including introducing new features, imposing limits on certain features, changing content offerings, or disabling certain functionalities. We may also temporarily suspend the Service for maintenance or upgrades. We will not be liable if all or any part of the Service is unavailable at any time for any period. Rappio.TV may, in its discretion, provide notice of significant changes to the Service, but is not required to do so. You acknowledge that the Service is continually evolving, and features or functionality may change over time. 19. Miscellaneous Provisions Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, then that provision shall be deemed severed from these Terms (or modified to the minimum extent necessary to make it enforceable), and the remaining provisions of these Terms will remain in full force and effect. The parties agree that no invalid or unenforceable provision will affect the validity or enforceability of the remaining provisions. In the event of a partly invalid provision, the provision shall be enforced to the maximum extent permitted. to best reflect the parties' intent. and the invalid portion will be deemed omitted. No Waiver. No failure or delay by Rappio.TV in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof. nor shall any single or partial exercise of any right, power, or privilege preclude any other or further exercise of that or any other right, power, or privilege. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Rappio.TV. A course of dealing or trade practice will not be relied upon to modify these Terms. Entire Agreement. These Terms (including any policies, guidelines, or additional agreements expressly incorporated by reference, such as our Privacy Policy or any Creator program terms) constitute the entire agreement between you and Rappio.TV with respect to the subject matter hereof, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding such subject matter. You acknowledge that you have not relied on any representation, warranty, or promise not expressly set forth in these Terms. Assignment. Rappio.TV may assign or transfer these Terms (in whole or in part), or any rights or delegate any obligations under these Terms, at any time with or without notice to you. For example, this could occur in the event of a merger, acquisition, sale of assets, or by operation of law. You may not assign or transfer these Terms, nor any rights or obligations hereunder, to any other person or entity without Rappio.TV’s prior written consent, and any attempt to do so without consent will be null and void. These Terms will bind and inure to the benefit of the parties and their respective permitted successors and assigns. No Third-Party Beneficiaries. These Terms are for the benefit of you and Rappio.TV (and Rappio.TV’s successors and assigns, if any). Except as expressly provided in these Terms, no third party shall have any rights to enforce any term of these Terms. The agreement between you and Rappio.TV to abide by these Terms does not create any third-party beneficiary rights. Relationship of the Parties. Nothing in these Terms will be construed to establish a partnership, joint venture, employment, or agency relationship between you and Rappio.TV. Neither party has the right or authority to create any obligation or responsibility on behalf of the other. Force Majeure. Rappio.TV will not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure results from causes outside its reasonable control, including, but not limited to, acts of God, natural disasters, pandemics, war, terrorism, riots, embargoes, labor or trade disputes, utility failures, outages or disruptions of the internet or telecommunications, government actions, or other similar causes (each a “Force Majeure” event). Rappio.TV will use reasonable efforts to mitigate the effects of any Force Majeure event and resume full performance as soon as feasible. Notices. Rappio.TV may provide notices or communications to you by email (to the address associated with your account), via in-Service messages or notifications, or by posting on the Rappio.TV website. You consent to receive electronic communications from us for all purposes. It is your responsibility to keep your contact information (especially your email) up to date. Official notices from you to Rappio.TV should be sent via email to hop@rappio.tv, and via postal mail to any physical address provided by Rappio.TV for its headquarters (if required by law or contract); please include “Attn: Legal Department” in the correspondence. Electronic notices will be deemed received by you within 24 hours of the time posted or sent by Rappio.TV, and written letters within 5 business days of mailing. Headings and Interpretation. Section headings in these Terms are for convenience only and have no legal or contractual effect. In these Terms, the words “including” and “include” mean “including, but not limited to.” Any ambiguities in the interpretation of these Terms shall not be construed against the drafter (which in this case is Rappio.TV). Language. These Terms are written in English (International).
